Unless explicitly stated otherwise in writing, the following standard fees and additional terms and conditions shall apply to all engineering services and products. Fureon specialized rates may be applied to work involved in three areas of expertise. Those areas are work involving the design, handling, safety and disposition of explosives as used in munition fuzing, mining or related explosive or initiation devices. Work involving the use of lasers such as devices related to laser ignition of energetic materials. Work related to the radiation hardening of electronics exposed to harsh radiation environments such as those expected in space or earthbound high radiation environments. In all other cases the general daily flat rate shall be billed per hour.

Standard hourly fees:

SME	$300	Hour	Subject Matter Expert: This rate will be used for engineering work that is highly specialized and uncommon. The rate is based on specialized knowledge accumulated over at least 10 years of personal experience in the art being applied.
Engineering	$270	Hour	Standard Engineering: This rate shall be applied for work that would be expected of individuals with at least a BS degree in engineering and 4 or more years of practice.
Technical	$180	Hour	Technical labor: This rate shall be applied for work that does not involve design, evaluation, advice or the instruction of others. This would apply to the technical skill involved in the work.
Daily	$165	Hour	Daily flat rate: This rate applies when work is not clearly defined or off site at a customer facility. This work may consume multiple days and may include non-productive time such as time spent waiting or scheduled work breaks. Work shall be billed as per the time spent at the work site or customer direction.

Additional Terms and Conditions:

1)	No Warranty: ALL ITEMS AND WORK PRODUCT SUPPLIED UNDER THE QUOTATION SHALL BE PROVIDED "AS IS". FUREON MAKES NO WARRANTY, EXPRESS IMPLIED, OR OTHERWISE, REGARDING THE DESIGN, FABRICATION AND ALL DELIVERABLES , INCLUDING ANY WARRANTY FOR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR ANY VIOLATION OF THIRD PARTY PROPERTY RIGHTS. FUREON SHALL NOT BE LIABLE TO CUSTOMER FOR AMOUNTS REPRESENTING LOSS OF PROFITS, LOSS OF BUSINESS, DIRECT OR INDIRECT OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL FUREON BE LIABLE FOR PUNITIVE DAMAGES, AND, NOTWITHSTANDING THIS PROVISION, CUSTOMER AGREES TO LIMIT ANY AND ALL DAMAGES TO THE AMOUNT OF THE QUOTATION.
2)	Payment by the customer shall indicate acceptance of the deliverable and/or service. Fureon LLC shall be given the option to replace or correct product identified by the customer as defective within 30 days of payment.
3)	Indemnification: The customer agrees to indemnify and hold harmless Fureon LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of the use of its products or services
4)	Stop work orders: The customer may decide to cancel their commitment at any time upon prior written notice to Fureon. The customer agrees to pay the design NRE, fabrication and material costs expended from the time the work started to the time the work is terminated as described on a final customer invoice. Any work, documentation and material in progress shall be provided to the customer upon payment of the final invoice provided.
5)	Quotes are valid for 30 Days from the issue date. Upon written acceptance, customer agrees that payment shall be due and owing to Fureon within 30 days from delivery. Late fees may apply if payment is not received within 30 days.
